Responsibility of employers for foreign workers introduced in Belarus by presidential decree

On May 21, President of Belarus Alexander Lukashenko signed Decree No. 202 “On increasing the role of employers in the field of external labor migration”, which provides for the responsibility of employers for foreign workers. This was reported by sb.by with reference to the press service of the Head of State.

In order to strengthen the requirements for attracting foreign labor, with the exception of citizens of the EAEU member states, employers have been assigned additional responsibilities. These include visiting migrants at home to study their living conditions, taking measures, if necessary, to eliminate identified violations and informing the competent government agencies, organizing mandatory testing of migrants for knowledge of Russian or Belarusian.

An employment contract must be concluded with a migrant within 30 days from the date of his entry into Belarus. At the same time, the temporary transfer of such an employee to another employer is prohibited in order to avoid using his labor without observing the established procedure for attracting foreign specialists.

Employers will also be required to organize control over the activities and conditions of stay of migrants, including determining the persons responsible for such control.

Failure to fulfill their obligations will entail administrative liability for employers, and for migrants – early termination of the employment contract and departure from the country.
